Welcome to You in 3D Figurines. These Terms & Conditions govern your use of our website and the purchase of our products and services. By placing an order with us, you agree to these terms. Please read them carefully.

1 About us

You in 3D Figurines (“we”, “us”, “our”) is a South African business that creates custom 3D-printed figurines, glass-art portraits, personalised accessories and related products, based on photographs and details supplied by our customers. 2 Definitions

• “Customer”, “you” — any person who places an order or uses our website.
• “Products” — figurines, glass portraits, personalised items and any other goods we offer.
• “Custom / personalised products” — items made to your specifications or from images, names or designs you provide.
• “Order” — a request to purchase Products, confirmed once payment is received.

3 Products & custom work

Most of our Products are made to order from the photographs, details and design choices you provide. Because each item is handmade and individually produced, slight variations in colour, finish, texture and detail are normal and are not regarded as defects. Product images and samples on our website are for illustration; your finished item is a hand-crafted interpretation and may differ slightly.

We will produce your item as closely as reasonably possible to the brief and any proof you approve.

4 Orders & confirmation

An order is only confirmed once we have received full payment (or any agreed deposit) and have acknowledged the order. We reserve the right to decline or cancel an order — for example where an item cannot be produced, where the supplied images are unsuitable, or where payment fails — in which case any amount paid will be refunded.

Where a proof or design preview is provided for your approval, production only begins after you approve it. It is your responsibility to check spelling, names, dates and details on the proof before approving.

5 Pricing & payment

All prices are shown in South African Rand (ZAR) and include VAT where applicable. Prices may change at any time, but confirmed orders are charged at the price agreed at the time of order.

Payments are processed securely through Payfast, our third-party payment provider. We do not store your full card details. By paying through Payfast you also agree to Payfast’s own terms. Your order is treated as confirmed once payment has cleared.

6 Delivery & collection

We deliver within South Africa via reputable courier services, and items may also be collected from our store at Baywest Mall, Gqeberha.

Production & delivery timeframes

• Production time: custom items typically take [INSERT e.g. 5–10] working days to produce, depending on the product and order volume.
• Delivery time: once dispatched, courier delivery usually takes [INSERT e.g. 2–5] working days, depending on your location.
• Delivery cost: calculated at checkout based on your address, or as quoted before payment.

Timeframes are estimates and may be affected by factors outside our control (courier delays, public holidays, incorrect addresses). We will keep you updated and provide tracking details where available. Please ensure your delivery address and contact number are correct — we are not responsible for delays or losses caused by incorrect details supplied by you.

Risk in the goods passes to you on delivery or collection.

7 Your responsibilities

• Provide clear, good-quality photographs and accurate details for custom items.
• Check and approve proofs carefully before production begins.
• Supply correct delivery information.
• Confirm that you have the right to use any photograph or image you submit (see clause 8).

8 Image rights & intellectual property

By submitting a photograph, image, logo or design to us, you confirm that you own it or have permission to use it, and that it does not infringe anyone else’s rights. You grant us permission to use the supplied material solely to produce your order.

We will not use images of identifiable people for marketing or promotion without your consent. All designs, branding, website content and original artwork created by You in 3D Figurines remain our intellectual property.

Note: We may decline to reproduce material that is offensive, unlawful, or that infringes third-party copyright or trademarks.

9 Cancellations, returns & refunds

Because our products are custom-made to your specifications, special rules apply to cancellations and refunds. Please read our full Refund & Returns Policy, which forms part of these Terms. Nothing in these Terms limits the rights you have under the Consumer Protection Act, 2008.

10 Limitation of liability

To the maximum extent permitted by law, our liability arising from any order is limited to the value of that order. We are not liable for indirect or consequential loss. Nothing in these Terms excludes liability that cannot lawfully be excluded, including your rights under the Consumer Protection Act.

11 Privacy

We handle your personal information, including any photographs you submit, in line with the Protection of Personal Information Act (POPIA). Please see our Privacy Policy for full details.

12 Governing law

These Terms are governed by the laws of the Republic of South Africa. Any dispute will be subject to the jurisdiction of the South African courts. You may also refer consumer complaints to the National Consumer Commission.

13 Changes to these terms

We may update these Terms from time to time. The version published on our website at the time of your order applies to that order. Please check this page periodically.
